Welcome to ShieldCheck, an iOS application developed by GoTrackApps ("Company," "we," "us," or "our"). ShieldCheck is designed to provide users with transparent and reliable device security audits, focusing on Wi-Fi security, internet speed, and password strength. By accessing or using the ShieldCheck application, you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. • Password Strength Assessment: Conducts a local, on-device assessment of your password complexity without transmitting any data. It provides valuable tips for strengthening your passwords and improving your digital security.

Important Disclaimer:

• ShieldCheck is NOT an antivirus application and does not detect or remove malware or viruses.
• ShieldCheck does NOT perform remote monitoring of your device or network. All security assessments, including password strength checks, are performed locally on your device.
• ShieldCheck focuses on basic digital hygiene and provides recommendations. It does not guarantee absolute security or protection against all threats.

3. User Responsibilities and Conduct

By using ShieldCheck, you agree to:

• Use the application only for lawful purposes and in accordance with these Terms.
• Not use the application in any way that violates any applicable federal, state, local, or international law or regulation.
• Not engage in any conduct that restricts or inhibits anyone's use or enjoyment of the application, or which, as determined by us, may harm GoTrackApps or users of the application or expose them to liability.

WITHOUT LIMITING THE FOREGOING, NEITHER GOTRACKAPPS NOR ANYONE ASSOCIATED WITH GOTRACKAPPS REPRESENTS OR WARRANTS THAT THE APPLICATION, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APPLICATION WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR APPLICATION OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APPLICATION OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APPLICATION WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL GOTRACKAPPS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APPLICATION, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE APPLICATION OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

You agree to defend, indemnify, and hold harmless GoTrackApps, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the application, including, but not limited to, your User Contributions, any use of the application's content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the application.

8. Governing Law and Jurisdiction

All matters relating to the application and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California, USA, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the application shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the City of Cupertino and County of Santa Clara, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country.
